TYPES OF ACTS
The purpose of this list is to classify specific types of violations and similar acts. As the scope of acts covered by human rights monitoring is continuously expanding, the list should not considered as comprehensive. However, it covers a broad range of acts and HURIDOCS regards it as a starting point for further development. Initiatives to adapt the Events Standard Formats for specialised use will certainly contribute to the evolution of this list.
This list is partially based on "Supporting Document J: Type of Event" (1).
The section on economic, social and cultural rights has been further enriched by incorporating relevant terms for violations from the Thesaurus of Economic, Social & Cultural Rights: Terminology and Potential Violations,by Stephen A. Hansen (2).
This list is hierarchical with five levels, following Rule No. 3 in the Introduction. New terms can be added to this list. However, care should be taken to include only terms that are mutually exclusive. Use the following conventions in adding new terms:
1. The first level is used to denote which right or cluster of related rights is violated
01 to 29 are for civil and political rights
30 to 49 are for rights of protected groups
50 to 69 are for economic, social and cultural rights
70 and above are for peoples' rights
2. The second level is used to categorise the type of violation, as follows
01 - direct actions in violation of the right in question
11 - acts of omission
21 - violations in terms of legislation or policy-making
31 - violations in terms of non-implementation of law or policy to fulfil the right in question
41 - instances of non-fulfilment of right
In the use of 11 for the second level, please note that there are two possibilities for its use. One is to indicate acts of omission constituting failure to provide protection. It is recommended however that such acts of omission, e.g., inaction of law enforcers in the face of killings, should be considered as levels of involvement. In this case, the law enforcers are treated as perpetrators in relation to specific acts, but on a different level of involvement compared to direct perpetrators.
The other use of 11 for the second level is to include categories that describe specific kinds of situations that deny rights to certain persons or groups. Categories such as very low pension and inadequate housing can be included.
As for the use of 41 for the second level, note that instance refers to an individual case which concerns one individual victim, as contrasted to a violation which affects a whole class or group. For example, the violationRestriction on dressing could be recorded as an act affecting all women in a society. In addition, one may record a specific instance (one woman actually being restricted).
3. For the violations in terms of legislation or policy-making, the third level is used as follows:
01 - promulgation of violative law or policy
02 - repeal of law or policy which used to guarantee the right
03 - promulgation of law or policy which reduces the effectiveness of previous guarantees
11 - lack of law or policy
The fourth and fifth levels are used for specific categories of types of acts that are part of those categories included at the previous levels.
